Types of Assault

Assault in the First Degree

First-degree assault involves attempting to kill someone or knowingly causing serious physical injury (RSMo § 565.050). This is a Class B felony punishable by 5–15 years in prison. If the incident actually results in serious physical injury to the other person, the charge escalates to a Class A felony, which carries 10–30 years or life in prison.

Assault in the Second Degree

Second-degree assault occurs when a person recklessly causes serious physical injury or knowingly causes injury using a deadly weapon or dangerous instrument (RSMo § 565.052). This is a Class D felony that carries up to seven years in prison.

Assault in the Third Degree

Third-degree assault involves knowingly causing physical injury to another person (RSMo § 565.054). This is a Class E felony that carries up to four years in state prison. 

Assault in the Fourth Degree

Fourth-degree assault covers recklessly causing physical injury, causing fear of immediate harm, or engaging in offensive physical contact (RSMo § 565.056). This is a Class A misdemeanor punishable by up to one year in county jail. Depending on the incident, it can sometimes be reduced to a Class C misdemeanor.

Is Assault a Felony or a Misdemeanor?

Assault in the first, second, and third degrees constitutes felony charges, while fourth-degree assault is typically a misdemeanor.
