Class B Felony DWI

Penalties may include up to 15 years in prison and a mandatory minimum of 2 years in prison.

Class A Felony DWI

A Class A felony DWI is the most severe. It applies to “habitual offenders” and defendants who 1.) cause a fatality or 2.) have a prior Class B felony DWI conviction and commit another Class B-level offense. Penalties include imprisonment for 10–30 years or life.
