Under 21 U.S.C. § 841, manufacturing, distributing, or possessing a controlled substance with intent to distribute can carry penalties tied to the substance, quantity, prior record, and other facts. It carries the same potential penalties as the underlying offense, even if the alleged transaction wasn’t completed. Prosecutors may also seek to hold someone responsible for quantities handled by others if they claim those amounts were part of the jointly undertaken activity and reasonably foreseeable.

How Federal Drug Investigations Develop in Kansas City

The United States Attorney’s Office for the Western District of Missouri prosecutes federal narcotics cases arising in the district. Investigations may involve the Drug Enforcement Administration, the Federal Bureau of Investigation, confidential informants, controlled purchases, surveillance, search warrants, or court-authorized wiretaps.
