Defense Strategies for Various Charges
In Grundy County, we at the Missouri DWI & Criminal Law Center frequently encounter a variety of criminal charges. Some of the most common charges include driving while intoxicated (DWI), drug possession, assault, and theft. We apply a range of defense strategies to protect our clients’ rights and advocate for their best interests.
Driving While Intoxicated
For DWI cases, we often challenge the validity of the field sobriety tests or the accuracy of the breathalyzer results. We may help a client by demonstrating that the arresting officer had insufficient probable cause or followed improper procedures during the arrest. For instance, in one recent case, we were able to prove that the officer did not follow the proper protocol for conducting a breathalyzer test, resulting in the dismissal of the DWI charges.
Drug Possession
When defending clients against drug possession charges, we examine the circumstances surrounding the discovery of the controlled substances. Common defense strategies include arguing that the drugs were found during an illegal search, proving that the substances belonged to someone else, or showing that the drugs were intended for personal use only. We have had success in reducing charges from felony possession to simple possession in cases where the quantity of drugs was low and there was no evidence of distribution.
Assault
In assault cases, we often use self-defense or defense of others as a valid argument. According to Missouri law, a person is justified in using physical force against another person if they reasonably believe it is necessary to protect themselves or someone else from imminent harm. We have successfully represented clients who have been wrongly accused of assault due to protecting themselves or their loved ones in dangerous situations.
Theft
In theft cases, we seek to establish reasonable doubt about our clients’ intention to steal by focusing on elements such as mistaken identity, lack of probable cause, or the consensual nature of a transaction. In one particular case, we demonstrated that our client had mistakenly taken an item that belonged to someone else, believing it was their own property, resulting in the charges being dropped.
